In custody disputes, the court will require a substantial change in circumstances and an argument that modifying custody is in the best interests of the child. The desires of an older child are considered, but the judge has the ultimate say. In a recent victory on behalf of a father who had primary custody, a 15-year-old boy wanted to go live with his mother, but we convinced the court that it was not in the youth's best interests.
In child support modification, the court also requires a substantial change in circumstances, such as a new job or promotion, or a job layoff. The court may require further proof that the noncustodial parent is seeking work and not intentionally underemployed to avoid support obligations.
