What is a No-Fault Divorce in Georgia?

Historically, most states, including the state of Georgia, required some proof of fault in order for a couple to get divorced. Starting in the 1970s, however, states began to focus on making the divorce process easier rather than more difficult. In 1973, Georgia added a “no-fault” option for people seeking a divorce in the state.

Georgia law contains a total of 13 different grounds or reasons for divorce. A claim that the marriage is “irretrievably broken” is referred to as a “no-fault” ground. This means that you don’t have to prove anything to the court before getting a no-fault divorce. This is the most common ground or reason for divorce under Georgia law, and usually the simplest type of divorce to pursue. When one spouse files for no-fault divorce, he or she states that he or she is unwilling to continue to live with the other spouse and there is no chance of reconciliation. This means that there is no hope of the parties ever getting back together.

A spouse is entitled to get a no-fault Georgia divorce even if the other spouse doesn’t agree that the marriage is irretrievably broken. Additionally, in a no-fault divorce, you do not have to show that either spouse committed some wrongdoing or is at fault for the divorce. One spouse just has to state that the marriage is irretrievably broken.  Essentially, if one spouse wants to get divorced, he or she may do so under Georgia law, even if the other spouse doesn’t want to get divorced. There is no way for the spouse to stop the divorce if the other spouse truly wants to get divorced.
